These Terms of Use (“Terms,” “Agreement”) constitute a legally binding agreement between you (“User,” “you,” “your”) and Real Estate Agent Journal, LLC (“Company,” “we,” “us,” “our”), including its predecessors, affiliates, subsidiaries, assigns, and successors in interest. These Terms govern your access to and use of our website, digital magazine, online content submission platform, paid article services, membership features (if any), analytics dashboards, content management tools, community features, directories, listings, editorial formats, and any related digital materials, tools, or resources now existing or developed in the future (collectively, the “Services”).

By visiting, interacting with, submitting content to, purchasing from, browsing, or otherwise using any part of our website or Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Policies, Privacy Policy, and any additional rules, guidelines, or disclosures posted on the Website, all of which are incorporated herein by reference.

For purposes of these Terms, the following definitions shall apply and govern interpretation throughout this Agreement:
“Services” refers to all digital goods, paid article features, listing features, spotlight placements, sponsored placements, editorial formats, interviews, contributor tools, submission portals, analytics, directories, user-generated content tools, archived content, migrated content, newsletters, promotional distributions, syndications, and related digital assets offered through or in connection with the Website.
“Company Content” means all text, formatting, branding, trade dress, logos, layouts, images, illustrations, photography, videos, code, databases, software, design elements, metadata, tagging systems, editorial frameworks, templates, and digital assets created, curated, licensed, or owned by Real Estate Agent Journal, LLC (formerly The Realtor Magazine, LLC), including all content originally published under TheRealtorMagazine.com that has been migrated, archived, or republished under RealEstateAgentJournal.com.
“User Content” means all text, articles, responses, images, videos, graphics, audio files, data, submissions, statements, comments, biographical information, professional credentials, links, attachments, or materials provided, uploaded, or transmitted by the User through the Services.
“Feature” refers to any paid article, listing feature, spotlight placement, sponsored editorial, premium placement, enhanced profile, interview, or other paid promotional content purchased through the Website.
“Website” means www.RealEstateAgentJournal.com, including all subdomains, microsites, archived pages, migrated content, prior-domain redirects, and any associated domains controlled by the Company, including content previously hosted under TheRealtorMagazine.com.
“Publisher” refers to Real Estate Agent Journal, LLC as the entity responsible for editorial decisions, content curation, publication scheduling, moderation, and distribution.
“Policies” refers collectively to all rules, content standards, submission guidelines, editorial policies, Fair Housing compliance standards, advertising policies, and community guidelines posted on the Website.

2. ACCEPTANCE & MODIFICATION OF TERMS
By accessing, browsing, or using the Website, you agree to comply with these Terms in full.

The Company reserves the right, at its sole discretion, to modify, amend, supplement, or update these Terms at any time, with or without prior notice. Such modifications may reflect changes in law, business practices, editorial standards, or operational requirements.
Modifications become effective immediately upon posting to the Website. Continued use of the Website following any modification constitutes your acceptance of the updated Terms.

You are responsible for reviewing these Terms periodically to ensure compliance. If you object to any changes, your sole remedy is to discontinue use of the Services.

3. ELIGIBILITY TO USE THE SERVICES

You will not impersonate another person or misrepresent your affiliation with any entity.
We reserve the sole right to deny, suspend, or terminate access to any User who fails to meet these eligibility standards or violates these Terms.

4. USE OF THE WEBSITE
4.1 Permitted Use
You agree to use the Website solely for legitimate business, educational, and informational purposes related to real estate services, professional storytelling, article submissions, networking, and magazine content.

You may view, share, and reference published articles for non-commercial, personal, or professional development purposes, provided you do not misrepresent ownership of the content.

4.2 Prohibited Use
You agree that you will not:

Access or attempt to access the Website through automated means, bots, scrapers, or unauthorized scripts;

Submit fraudulent, defamatory, misleading, or discriminatory information;

Misrepresent your identity, credentials, licensing, or experience;

5. PURCHASES, PAYMENT TERMS & NON-REFUNDABLE FEES
5.1 Payment Terms
All payments for Services are due immediately upon purchase. You authorize the Company to process payment using the method provided at checkout.
5.2 Non-Refundable Fees
ALL SALES ARE FINAL. ALL FEES ARE NON-REFUNDABLE.

This applies to all paid article features, upgrades, add-ons, editorial services, licensing fees, bundles, packages, or any other digital Services.

5.3 No Refund for User Errors
Refunds will not be issued for:

Mistaken purchases

Duplicate orders

Incomplete submissions

Dissatisfaction with self-submitted content

Failure to upload required materials

Low-quality images or submissions

Missed deadlines, email issues, or failure to follow instructions

5.4 No Refund for Violations
If User Content violates any Policy, Fair Housing law, copyright law, or these Terms, the User forfeits all fees paid and remains responsible for any legal consequences.

5.5 No Warranty of Results
Purchasing a feature does not guarantee leads, visibility, website traffic, sales, engagement, SEO ranking, exposure, or measurable results.

6. USER-GENERATED CONTENT
6.1 Responsibility for Content
You are solely responsible for all User Content that you submit, upload, transmit, post, or otherwise make available through the Services. By submitting User Content, you represent, warrant, and covenant that:

The content is accurate, truthful, and not misleading;

You are the lawful owner of the content or have all necessary rights, licenses, permissions, and consents to submit and authorize its use as contemplated herein;

The content is original to you or properly licensed, and does not infringe, misappropriate, or violate any intellectual property rights, privacy rights, publicity rights, contractual rights, or other proprietary rights of any third party;

The content does not contain defamatory, libelous, obscene, discriminatory, harassing, or unlawful material;

The content complies with all applicable federal, state, and local laws, including but not limited to Fair Housing laws, advertising regulations, and professional licensing standards;

You have obtained any necessary releases, permissions, or consents from individuals appearing in or referenced by your content, including model releases, photo releases, or client permissions where applicable.
You acknowledge that the Company does not pre-screen all User Content and is not responsible for verifying its accuracy, legality, or compliance. Any reliance on User Content is at your own risk.

6.2 License to Real Estate Agent Journal, LLC
By submitting User Content, you grant to Real Estate Agent Journal, LLC (including its predecessors, affiliates, successors, and assigns) a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable, and transferable license to:

Publish, display, distribute, and transmit your content across the Website, associated domains, newsletters, and third-party platforms;
-
Modify, edit, translate, adapt, or reformat your content for editorial quality, clarity, legal compliance, or technical compatibility;
-
Archive, store, back up, and migrate your content across current or future platforms, domains, or technological systems, including content originally published under TheRealtorMagazine.com;
-
Use, reproduce, excerpt, or feature your content in promotional, marketing, educational, or editorial materials, including social media, advertisements, and press communications;
-
Create derivative works based on your content, including summaries, highlights, compilations, or curated collections.
You acknowledge and agree that this license allows the Company to continue hosting, displaying, and utilizing your content even if your account is terminated, suspended, or deactivated.

6.3 Content Removal
The Company reserves the absolute right, in its sole discretion, to remove, edit, restrict access to, or decline to publish any User Content at any time and for any reason, including but not limited to:

Violation of these Terms or any Company Policies;

Allegations of copyright, trademark, or other intellectual property infringement;

Complaints from third parties;
-
Non-compliance with Fair Housing or advertising laws;
-
Content deemed inappropriate, misleading, harmful, or damaging to the Company’s reputation.
You acknowledge that removal, editing, or refusal to publish User Content does not entitle you to a refund of any fees paid.

6.4 Ownership of Editorial Design
You retain ownership of your original User Content, subject to the license granted herein. However, you acknowledge and agree that:

The Company exclusively owns all editorial design, layout, formatting, templates, visual presentation, and underlying code used to display your content;

You may share a direct link to your published article page, but you may not reproduce, replicate, scrape, or copy the Company’s design, layout, or branding;

You may not remove, alter, obscure, or modify any Company logos, watermarks, or editorial elements associated with your published content;
-
Any unauthorized reproduction of the Company’s editorial design may result in legal action.

7. PUBLISHING RIGHTS & EDITORIAL DISCRETION
The Company retains full and exclusive editorial control over all aspects of publication, including but not limited to:

Article formatting, style, and structure;

Headline creation, modification, or optimization;

Image selection, placement, or cropping;
-
Placement within the Website or magazine;
-
Scheduling, prioritization, or reordering of features;
-
Editing for grammar, clarity, legal compliance, or journalistic standards.
Purchasing a Feature does not grant you editorial control or approval rights over final presentation.

8. INTELLECTUAL PROPERTY RIGHTS
All Company Content is owned or licensed by Real Estate Agent Journal, LLC (including content originally published under The Realtor Magazine, LLC) and is protected by U.S. and international intellectual property laws, including copyright, trademark, trade dress, and database rights.

You may not:

Copy, reproduce, or distribute Company Content without express written permission;

Modify, adapt, or create derivative works from Company Content;

Reverse engineer or extract underlying code, structure, or databases;
-
Use Company Content for commercial purposes without authorization.
Any unauthorized use may result in legal action, including injunctive relief and damages.

9. DISCLAIMERS
The Website and Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied.
The Company expressly disclaims any and all warranties, including but not limited to:

Merchantability;

Fitness for a particular purpose;

Non-infringement;

Accuracy, reliability, or completeness of content;

Uninterrupted or error-free operation of the Website.
You acknowledge that use of the Services is at your own risk.

10. LIMITATION OF LIABILITY

If you do not agree with this limitation, your sole remedy is to discontinue use of the Website.

11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Real Estate Agent Journal, LLC (including its predecessor, The Realtor Magazine, LLC), its owners, officers, employees, contractors, affiliates, and partners from any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from:

Your User Content;

Your violation of these Terms or applicable law;

Third-party claims related to your submissions.
This obligation survives termination of your account or use of the Website.

12. TERMINATION OF ACCESS
The Company reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for reasons including but not limited to:

Termination does not entitle you to any refund.

13. ARBITRATION AGREEMENT

16. ENTIRE AGREEMENT
These Terms, together with the Company’s Policies and Privacy Policy, constitute the complete and exclusive agreement between you and Real Estate Agent Journal, LLC.

No prior or contemporaneous oral or written statements modify these Terms.
